Terms of Service

1. Acceptance of terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the service

Fantasy Auction AI is a fantasy sports auction draft assistant and mock draft tool. It provides player projections, dollar valuations, inflation tracking, bid recommendations, draft grades, and simulated results.

All projections, valuations, and recommendations are informational only. They are estimates, not guarantees. We do not promise any particular fantasy outcome, draft result, or league standing. You are solely responsible for the decisions you make during your draft and season.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.

4. Account responsibilities and security

To use certain features, you must create an account. You agree to:

• Provide accurate information and keep it current.
• Keep your login credentials confidential.
• Be responsible for all activity that occurs under your account.
• Notify us promptly at obizues@duck.com if you suspect any unauthorized use of your account.

We are not liable for any loss arising from unauthorized use of your account that results from your failure to keep your credentials secure.

5. Acceptable use

You agree that you will not:

• Scrape, crawl, or harvest data from the Service by automated means.
• Abuse, disrupt, overload, or interfere with the Service or its infrastructure.
• Reverse engineer, decompile, or attempt to derive the source code, models, or valuations of the Service.
• Resell, sublicense, redistribute, or otherwise commercially exploit the Service or its output without our written permission.
• Use the Service to violate any law or the rights of any third party.

We may suspend or terminate access for any violation of this section.

6. User content and drafts

You own the draft data you create, including your league settings, draft events, and archived drafts ("Your Content"). We store Your Content so we can provide the Service to you, such as recovering a draft in progress and letting you revisit past drafts.

You grant us a limited license to store, process, and display Your Content solely to operate and provide the Service to you. We do not claim ownership of Your Content.

7. Intellectual property

The Service, including its software, design, brand, name, logos, projections, valuation methods, and models, is owned by us and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in and to the Service. You may not use our brand or marks without our written permission.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error free, or accurate. Fantasy outcomes are not guaranteed. Projections, valuations, and recommendations may be wrong.

Fantasy Auction AI is an independent tool. It is not affiliated with, endorsed by, or sponsored by the National Football League (NFL), Yahoo, ESPN, or any other league, platform, or content provider. All team names, player names, and league marks are the property of their respective owners.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred United States dollars.

10. Indemnification

You agree to indemnify and hold harmless Chris Obermeier and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any right of a third party.

11. Termination

You may stop using the Service and delete your account at any time from your account page. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

12. Changes to the terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of laws rules.
